Terms of Service

1. Acceptance

By creating an account or using TradeReply, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

2. Service Description

TradeReply provides AI-powered missed call recovery for trade contractors. We provide a dedicated phone number, automatic SMS follow-up when you miss a call, AI-driven job intake conversations, emergency detection, and a dashboard to manage your leads. Messages are delivered via Telnyx and processed by Anthropic Claude AI.

3. SMS Messaging Terms

By using TradeReply, you acknowledge and agree to the following SMS messaging terms:

• Consent: Callers who are forwarded to your TradeReply number receive an initial text explaining the SMS follow-up. By responding, they provide opt-in consent for the conversation.
• Opt-Out: Callers can reply STOP at any time to stop receiving messages. You agree not to send messages to callers who have opted out.
• Message Content: Our AI handles job intake conversations. You are responsible for the accuracy of your business information configured in settings. Do not configure your account to facilitate prohibited content including spam, phishing, illegal content, or deceptive messaging.
• Compliance: You agree to comply with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and all applicable federal, state, and carrier regulations regarding SMS messaging.
• Message Rates: Standard message and data rates may apply to callers. Message frequency varies based on conversation activity.
• No Sharing: Phone numbers collected through TradeReply will not be shared with third parties for marketing purposes.

4. Acceptable Use

You agree not to:

• Send unsolicited bulk SMS messages (spam)
• Use the service for illegal purposes
• Impersonate other businesses or misrepresent your identity
• Interfere with the service or other users' access
• Violate carrier messaging policies or regulations

5. Billing

TradeReply is billed at $49/month via Stripe. Your first 14 days are free. You may cancel at any time. Refunds are handled on a case-by-case basis.

6. AI Disclaimer

TradeReply uses AI to conduct job intake conversations via SMS. While we strive for accuracy, AI responses may occasionally be incorrect or miss context. You are responsible for reviewing job details on your dashboard and following up with callers as needed.

7. Limitation of Liability

TradeReply is provided “as is” without warranties. Naptown Labs is not liable for any indirect, incidental, or consequential damages arising from your use of the service, including but not limited to lost revenue, message delivery failures, or AI response errors.

8. Termination

We may suspend or terminate your account for violations of these terms, particularly for SMS spam or abuse. Upon termination, your data will be deleted within 30 days.
